These Terms of Service ("Terms") apply to your access to and use of this website, any mobile-optimized version of the site, and any related pages, content, and services (collectively, the "Services") operated by Crash Check ("Crash Check", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Services.

Nature of the Services
Crash Check is a marketing and referral platform. We are not a law firm, an attorney, a legal service provider, or an insurance company. We do not provide legal advice, legal representation, or insurance, and using the Services does not create an attorney-client relationship. We connect people who have been in a motor vehicle accident with independent third-party attorneys, law firms, legal service providers, and insurance providers. We do not make legal decisions, evaluate the merits of your case, negotiate with insurers, or guarantee any outcome, result, or specific offer.
How the Services Work
When you submit your information through the Services, your information may be shared with one or more providers in our network. Those providers may contact you by phone, SMS, email, or postal mail regarding their products and services, subject to the consent you provide at the time of submission and applicable law. Eligibility
You must be at least 18 years old and a legal resident of the United States to use the Services. By using the Services, you represent that you meet these requirements and are not barred from using the Services under applicable law.
No Guarantee; No Legal or Insurance Services
Nothing on the Services constitutes legal advice, an offer to represent you, or a commitment to provide any legal or insurance service. We do not guarantee that you will be contacted by a provider, that any provider will accept your matter, or that any particular result will be achieved. Any decision to engage a provider, and the terms of that engagement, are strictly between you and that provider.
User Consent to Be Contacted
By submitting a form, you may be providing your express written consent to be contacted, including by automated telephone dialing system, artificial or pre-recorded voice, and text/SMS messages, even if your number is on a state or federal Do Not Call list. This consent is not a condition of receiving assistance, and you may opt out at any time through our Unsubscribe page or by replying STOP to any text message.
Acceptable Use
You agree not to: violate any law; submit false, misleading, or fraudulent information; submit information about another person without their permission; interfere with or disrupt the Services; use automated tools to collect data from the Services; reverse engineer any part of the Services; impersonate any person or entity; or use the Services in any way that could cause harm or expose us to liability.
Intellectual Property
The Services and all content on them, including text, graphics, logos, images, and software, are the property of Crash Check or its licensors and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any content without our prior written permission.

The Services contain links to third-party websites, including the websites of providers in our network. We do not control and are not responsible for the content, privacy policies, or practices of any third-party website. Your access to and use of third-party sites is at your own risk.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CRASH CHECK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Indemnification
You agree to indemnify and hold harmless Crash Check and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your access to or use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
Dispute Resolution; Binding Arbitration
Except for disputes in which either party seeks to bring an individual action in small claims court or seeks injunctive or other equitable relief for the alleged unlawful use of intellectual property, you and Crash Check waive your rights to a jury trial and to have any dispute arising out of or relating to these Terms or the Services resolved in court. Instead, such disputes will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA).
You and Crash Check agree that any dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action, or any other type of representative proceeding. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@crashcheck.com.
Governing Law and Venue
These Terms and your access to and use of the Services will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law rules. Subject to the arbitration provision above, any disputes will be resolved in the state or federal courts located in Delaware.
Termination
We reserve the right, without notice and in our sole discretion, to terminate or suspend your right to access or use the Services at any time and for any reason.
Changes to These Terms
We may change these Terms from time to time by updating the "Last updated" date above. Your continued use of the Services after any change becomes effective constitutes your acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision is severable and the remaining provisions will remain in full force and effect.
